भारत की संसद
संविधान के भाग 5 के अनुच्छेद 79 से 122 में संसद के गठन, संरचना, शक्तियां, प्रक्रियाएं विशेष अधिकार आदि का वर्णन किया गया है।
Articles 79 to 122 of Part V of the Constitution describe the formation, composition, powers, procedures, special rights, etc. of the Parliament.
ARTICLE - 79 Constitution of Parliament
अनुच्छेद - 79 संसद का गठन
इसके अनुसार संघ की एक सांसद होगी जो राष्ट्रपति और दो सदनों से मिलकर बनेगी और जिनके नाम लोकसभा व राज्यसभा होंगे।
According to this, the Union will have one Parliament which will consist of the President and two Houses named Lok Sabha and Rajya Sabha.

पहले राज्यसभा का नाम राज्य परिषद और लोकसभा का नाम जनता का सदन था जिसे 1954 में बदल दिया गया। भारत में पहली संसद का गठन अप्रैल 1952 में हुआ जिसकी बैठक पहली बैठक मई 1952 में हुई।
Earlier the name of Rajya Sabha was Rajya Parishad and Lok Sabha was the name of the People's House which was changed in 1954. The first Parliament of India was constituted in April 1952 and its first meeting was held in May 1952.
राज्यसभा / Lok Sabha
अनुच्छेद 80 के अनुसार राज्यसभा का गठन अधिकतम 250 सदस्यों द्वारा होगा जिसमें से 238 का चुनाव राज्य विधानसभाओं के सदस्यों द्वारा तथा 12 को मनोनीत राष्ट्रपति (कला , साहित्य, विज्ञान व समाजसेवा के क्षेत्र में विशेष ज्ञान रखने वाले व्यक्तियों में से करता है।
According to Article 80, Rajya Sabha will have a maximum of 250 members out of which 238 will be elected by the members of state assemblies and 12 will be nominated by the President from among the persons having special knowledge in the field of art, literature, science and social service.
किंतु वर्तमान में इसमें 245 सदस्य हैं जिसमें 233 निर्वाचित व 12 मनोनीत सदस्य होते हैं।
250 = 238 + 12 (अधिकतम/Maximum)
245 = 233 + 12 (वर्तमान में/At present)
राज्यसभा सदस्यों का निर्वाचन :-
Election of Rajya Sabha members :-
· राज्यसभा के सदस्यों का निर्वाचन का राज्य विधानसभाओं के निर्वाचित सदस्य करते हैं अर्थात राज्यसभा के सदस्यों का चुनाव अप्रत्यक्ष होता है।
The members of the Rajya Sabha are elected by the elected members of the state legislative assemblies, that is, the election of the members of the Rajya Sabha is indirect.
· चुनाव आनुपातिक प्रतिनिधित्व पद्धति के अनुसार एकल संक्रमणीय मध्य प्रणाली के द्वारा होता है।
The election is held according to the system of proportional representation by means of the single transferable vote system.
· राज्यसभा में राज्यों की सीटों का बंटवारा उनकी जनसंख्या के आधार पर किया जाता है और इसका वर्णन अनुसूची 4 में दिया गया है।
The distribution of seats among the states in the Rajya Sabha is done on the basis of their population and is described in Schedule 4.
· उदाहरण - उत्तर प्रदेश 31 सीटें (सर्वाधिक) , एमपी में 11 सीटों, त्रिपुरा आदि को 1सीट।
Example - Uttar Pradesh 31 seats (maximum), MP 11 seats, 1 seat to Tripura etc.
· केंद्र शासित क्षेत्रों में केवल दिल्ली व पुडुचेरी को राज्यसभा में प्रतिनिधित्व दिया गया है बाकी 5 को नहीं।
Among the Union Territories, only Delhi and Puducherry have been given representation in the Rajya Sabha and the other five have not.
· राज्यसभा चुनाव में खड़े होने के लिए यह आवश्यक नहीं है कि उस व्यक्ति का नाम उसे राज्य की मतदाता सूची में हो ।जैसे- डॉक्टर मनमोहन सिंह, असम विधानसभा से चुने गए।
To stand in Rajya Sabha election it is not necessary that the name of the person should be in the voter list of that state. For Example - Dr. Manmohan Singh was elected from Assam Assembly.
न्यूनतम आयु सीमा - 30 वर्ष / Minimum Age Limit - 30 Years
· शपथ- संसद का प्रत्येक सदस्य (लोकसभा या राज्यसभा) अपना स्थान ग्रहण से पूर्व राष्ट्रपति या उसके द्वारा नियुक्त किसी व्यक्ति के समक्ष शपथ लेता है।
Oath- Every member of the Parliament (Lok Sabha or Rajya Sabha) takes oath before the President or a person appointed by him before taking his seat.
· वह संविधान के प्रति सच्ची श्रद्धा व निष्ठा तथा भारत की एकता और अखंडता को बनाए रखने और अपने कर्तव्यों को श्रद्धापूर्वक पालन करने की शपथ लेते हैं।
He takes an oath to bear true faith and allegiance to the Constitution and to maintain the unity and integrity of India and to perform his duties faithfully.
· बिना शपथ लिए कोई भी सदस्य ना तो सदन की कोई कार्यवाही में हिस्सा ले सकता है और ना ही मत देख सकता है।
Without taking oath, no member can take part in any proceedings of the House or observe any vote.
अधिवेशन / Session :-
दो अधिवेशनों के मध्य 6 माह से अधिक समय नहीं हो सकता अर्थात वर्ष में काम से कम दो अधिवेशन होना अनिवार्य है । एक साल में तीन सत्र होते हैं।
There cannot be a gap of more than 6 months between two sessions, i.e. it is mandatory to have at least two sessions in a year. There are three sessions in a year.
कार्यकाल / Tenure :-
· यह एक स्थाई सदन हैजो कभी भी विघटित भंग नहीं होती किंतु इसके1/3 सदस्य प्रत्येक 2 वर्ष के बाद रिटायर्ड हो जाते हैं और इस प्रकार राज्यसभा का सामान्य चुनाव प्रत्येक 2 वर्ष में होता है।
