राष्‍ट्रीय मानवाधिकार आयोग

राष्‍ट्रीय  मानवाधिकार  आयोग भारत में एक वैधानिक निकाय  है जो पूरे देश  में  मानवाधिकारों की रक्षा संरक्षण  और बढ़ावा देने  के उद्देश्‍य से कार्य करता है राष्‍ट्रीय मानवाधिकार आयोग एक  वैधानिक निकाय है जिसे  मानवाधिकार संरक्षण  अध्‍िनियम 1993 के तहत  स्‍थापित यिका गया  यह एक संविधानिक संस्‍था नहीं है

 The National Human Rights Commission is a statutory body in India that works with the objective of protecting, preserving and promoting human rights throughout the country. The National Human Rights Commission is a statutory body established under the Protection of Human Rights Act 1993. It is not a constitutional body.

संरचना- एक  अध्‍यक्ष 5 सदस्‍य एवं 7 अतिरिक्‍त  पदेन सदस्‍य होते हैं  Composition- One Chairman, 5 members and 7 additional ex officio members

अध्‍यक्ष- भारत के सेवा निवृत मुख्‍य न्‍यायधीश या सर्वोच्‍च न्‍यायालय के न्‍यायाधीश

 Chairman- Retired Chief Justice of India or Supreme Court Judge

सदस्‍य- 5 सदस्‍यों  में से प्रथम सदस्‍य सर्वोच्‍च न्‍यायालय के सेवारत या सेवा  निवृत न्‍यायाधीश

 Members - First out of 5 members, serving or retired judge of the Supreme Court

द्वितीय सदस्‍य-  किसी उच्‍च न्‍यायालय के सेवारत या  सेवा निवृत मुख्‍य न्‍यायाधीश

Second Member- Serving or retired Chief Justice of a High Court

तीसरा,चौथा और पांचवा -सदस्‍य  मानवाधिकारों के सबंध में ज्ञान या व्‍यवहारिक अनुभव रखने वाले व्‍यक्ति होंगे। इन तीन सदस्‍यों में से एक सदस्‍य  का महिला होना अनिवार्य है।

Third, fourth and fifth - members will be persons having knowledge or practical experience in relation to human rights. One of these three members must be a woman.

नियुक्‍त -  अध्‍यक्ष  और सदस्‍यों  की नियुक्‍ति  प्रधानमंत्री  की अध्‍यक्षता  वाली एक उच्‍च स्‍तरीय समीति  की सिफारिश  पर राष्‍ट्रपति द्वारा कीजाती है ।

 Appointment - The Chairperson and Members are appointed by the President on the recommendation of a high-level committee headed by the Prime Minister.

कार्यकाल- अध्‍यक्ष एवं सदस्‍य तीन वर्ष की अवधि या 70 वर्ष की आयु इसमें से जो पहले हो पद  पर बने रहेंगे ।

 Tenure-The Chairperson and Members shall hold office for a term of three years or till attainment of the age of 70 years, whichever is earlier.

राष्‍ट्रीय मानवाधिकार आयोग के पास पांच  प्रभाग हैं

The National Human Rights Commission has five divisions

कानून, जॉंच, नीति अनुसंधान, कार्यक्रम प्रशिक्षण, प्रशासन

Law, Investigation, Policy Research, Programme Training, Administration

मानवाधिकार आयोग का मुख्‍यालय नई दिल्‍ली  में है एवं वर्तमान में भारत के 24 राज्‍यों में राज्‍य स्‍तरीय मानवाधिकार आयोग का गठन किया गया है

The headquarters of the Human Rights Commission is in New Delhi and at present State Level Human Rights Commission has been constituted in 24 states of India.

प्रमुख कार्य-

Main functions-

मानवाधिकारों  के उल्‍लघंन की जांच करना मानवाधिकारों के क्षेत्र में अनुसंधान को बढ़ावा देना और मानवाधिकारों के बारे में जागरूकता बढ़ाना

 Investigating violations of human rights, promoting research in the field of human rights and raising awareness about human rights

कुछ  अन्‍य प्रमुख कार्य निम्‍नानुसार है

 Some other important functions are as follows

अनुसंधान- मानवाधिकारों के क्षेत्र में अनुसंधान को  बढ़ावा देना और संचालित करना

Research - promoting and conducting research in the field of human rights

जागरूकता- प्रकाशन, मीडिया, सेमीनार के माध्‍यम  से  मानवाधिकारों के बारे में जागरूकता बढ़ाने का प्रयास करना

Awareness - attempts to raise awareness about human rights through publications, media, seminars

सुधार- आयोग मानवाधिकारों के उल्‍लघंन से सबंधित किसी भी न्‍याय प्रककिया में हस्‍तक्षेप  कर  सकता है और उचित कार्यवाही की सिफारिश कर सकता  है।

Reforms- The Commission can intervene in any judicial process related to the violation of human rights and recommend appropriate action.

निरिक्षण-  एनएचआरसी  जेलों और अन्‍य संस्‍थानों  का दौरा कर वहां की स्थितियों का  निरीक्षण कर सकता  है और सुधार के लिए सिफारिश  कर  सकता है।

Inspection- The NHRC may visit prisons and other institutions to inspect the conditions there and make recommendations for improvements.

जॉंच-  एनएचआरसी मानवाधिकारों के उल्‍लघंन से संबंधित किसी  भी न्‍यायिक प्रकरण में हस्‍तक्षेप कर सकता है और उचित कार्यवाही की सिफारिश कर  सकता है

Investigation- NHRC can intervene in any judicial case related to the violation of human rights and recommend appropriate action

सिफारिशें- एनएचआरसी सरकार को मानवाधिकारों के उल्‍लघंन को रोकने और मानवाधिकारों की रक्षा के लिए उपयुक्‍त कदम  उठाने की सिफारिश कर  सकता है।

Recommendations- NHRC can recommend the government to take appropriate steps to prevent human rights violations and protect human rights.

समीक्षा-  एनएचआरसी संविधान और अन्‍य कानूनों में मानवाधिकारों में संबंधित प्रावधानों की समीक्षा भी करता है और आवश्‍यक सुधारों की सिफारिश करता है

Review- NHRC also reviews the provisions relating to human rights in the Constitution and other laws and recommends necessary amendments
