Articles 89 to 92 – Deal with the Chairman and Deputy Chairman of the Rajya Sabha (Council of States)
अनुच्छेद 89 से 92 — राज्यसभा (राज्यों की परिषद) के सभापति और उपसभापति से संबंधित
अनुच्छेद 89:- राज्य सभी का सभापति और उपसभापति।
Article 89:- Speaker and Deputy Speaker of the State.
भारत का उपराष्ट्रपति स्वत: राज्य सभा का सभापति होगा।
The Vice President of India will automatically be the Chairman of the Rajya Sabha.
राज्यसभा का उपसभापति राज्य सभा के सदस्यों में से ही बनता है। अर्थात् चुना जाता है।
The Deputy Chairman of the Rajya Sabha is elected from amongst the members of the Rajya Sabha.
अनुच्छेद 90- उपसभापति का पद रिक्त होना इस्तीफा, पद हटाने की प्रक्रिया
Article 90 - Vacancy of office of Deputy Chairman, resignation, procedure for removal
1. यदि उपसभापति राज्यसभा का सदस्य नहीं रहेगा तो वह उपसभापति का पद स्वत: खाली होगा। If the Deputy Chairman ceases to be a member of the Rajya Sabha, the office of the Deputy Chairman shall automatically become vacant.
2. उपसभापति अपने पद से इस्तीफा दे सकता है। The Deputy Speaker may resign from his office.
3. उपसभापति को पद से हटाने के लिए राज्यसभा में प्रस्ताव पारित करेगी लेकिन प्रस्ताव लाने से कम से कम 14 दिन पहले सूचना देना आवश्यक है। Rajya Sabha will pass a resolution to remove the Deputy Chairman from his post but it is necessary to give notice at least 14 days before bringing the resolution.
अनुच्छेद 91- जब सभापति अनुपस्थित हो या पद रिक्त हो तो उपसभापति (या अन्य सदस्य) सभापति के कर्तव्यों को निभाएगा। Article 91- When the Chairman is absent or the office is vacant, the Deputy Chairman (or any other member) shall perform the duties of the Chairman.
अनुच्छेद 92:- हटाने के प्रस्ताव में सभापति/उपसभापति द्वारा अध्यक्षता न करना।
Article 92:- Speaker/Deputy Speaker not to preside over the motion for removal.
1. अगर सभापति/उपसभापति को पद से हटाने का प्रस्ताव लाया जाये तो वह स्वयं उस बैठक अध्यक्षता नहीं कर सकते। If a motion is moved to remove the Chairman/Deputy Chairman from his post, he cannot himself preside over the meeting.
